    Mjesto i uloga Obavještajno sigurnosne / bezbjednosne agencije BiH u sigurnosnom sistemu Bosne i Hercegovine

    Reforma obavještajnih službi u Bosni i Hercegovini utvrđena je kao jedan od ključnih uvjeta za početak pregovora BiH sa Evopskom unijom o sporazumu o stabilizaciji i pridruživanju. Međunarodna zajednica tražila je da zakon o jedinstvenoj obavještajno-sigurnusnoj službi Parlament BiH usvoji što prije, a prve inicijative o tome uslijedile su 2002. godine nakon novembarske / studeni konferenciji u Londonu (Velika Britanija), kada je usvojena "Londonska deklaracija o organiziranom kriminalu na Balkanu".

    Ta velika međunarodna konferencija o organiziranom kriminalu u jugoistočnoj Evropi, koju je upriličila britanska Vlada, pokazala je da se borba protiv organiziranog kriminala uvršćuje u prioritetne aktivnosti, kako država regiona, tako i međunarodne zajednice u ovom slučaju oličene u Evropskoj uniji. Takvo opredjeljenje tražilo je reformu sistema bezbjednosti i u BiH i u regionu u cjelini, a sve u pravcu što efikasnije i organiziranije borbe protiv prijetnji koje nosi međunarodni organizirani kriminal i terorizam.

    Ovom Londonskom deklaracijom učesnici konferencije obavezali su se na borbu protiv organiziranog kriminala na njegovom izvorištu, u tranzitu odnosno u prekograničnim aktivnostima i konačno na samom odredištu, odnosno djelovanjem protiv kriminalaca iz regiona koji operiraju u stranim zemljama. Međunarodna zajednica će, stoji u ovom dokumentu, nastaviti da pruža pomoć kako bi se ostvarile obaveze koje su na skupu u Londonu preuzele zemlje regiona koje će zauzvrat morati da pruže opipljive rezultate.

    Upravo to - opipljivi rezultati - sada se očekuju od Obavještajno sigurnosne / bezbjednosne agencije BiH koja je dobila značajno mjesto i u BiH, i u regionu, da u saradnji sa ostalim institucijama iz sistema bezbjednosti unutar BiH i van nje, odgovori nadleženostima koje su precizirali inostrani i domaći pravni eksperti, a zakonodavno tijelo realiziralo usvajanjem Zakona o obavještajno sigurnosnoj / bezbjedonsoj agenciji BiH čime je ova instutucija smještana u samo žarište unutarnjih, regionalnih i evropskih napora u borbi protiv kriminala i korupcije i uvođenju vladavine prava u regionu.

    Formiranje OSA / OBA BiH

    Dana 22. marta / ožujka 2004. godine, na osnovu člana IV.4.a) Ustava Bosne i Hercegovine, Parlamentarna skupština Bosne i Hercegovine, na sjednici Predstavničkog i Doma naroda, usvojila je Zakon o obavještajno - sigurnosnoj agenciji Bosne i Hercegovine. Ovaj zakon stupio je na snagu osmog dana od dana objavljivanja u Službenom glasniku Bosne i Hercegovine br. 12, od 14.04.2004. godine, a Agencija je počela sa radom 01. juna 2004. godine.

    Dakle, pomenutim Zakonom osnovana je Obavještajno sigurnosna / bezbjednosna agencija Bosne i Hercegovine koja je odgovorna za prikupljanje, analiziranje i distribuiranje obavještajnih podataka u cilju zaštite sigurnosti, uključujući suverenitet, teritorijalni integritet i ustavni poredak Bosne i Hercegovine.

    Bitno je naglasiti da Agencija obavlja svoj rad u skladu s odredbama Ustava Bosne i Hercegovine, uključujući odredbe Evropske konvencije o zaštiti ljudskih prava i osnovnih sloboda i njenih protokola, te međunarodne ugovore i sporazume koje je BiH potpisala ili im je pristupila.

    Prema zakonskom rješenju, Agencija je civilna obavještajno-sigurnosna institucija koja ima status nezavisne administrativne organizacije Bosne i Hercegovine. Agencija ima status pravnog lica.

    U sastav Agencije ušle su civilne obavještajno-sigurnosne institucije koje su ranije djelovale u entitetima - u Federaciji Bosne i Hercegovine i u Republici Srpskoj. Zakonom je određeno da se na teritoriji Bosne i Hercegovine ne mogu osnivati ni djelovati nikakve druge civilne obavještajno-sigurnosne strukture.

    Finansijska sredstva za rad Agencije u cjelini se obezbjeđuju iz državnog budžeta, u skladu sa zakonom koji regulira Trezor institucija Bosne i Hercegovine.

    Sjedište Agencije je u Sarajevu, ulica Mehmeda Spahe 7.





    Nadležnosti OSA / OBA BiH

    Obavještajno sigurnosna / bezbjednosna agencija BiH odgovorna je za prikupljanje obavještajnih podataka u vezi s prijetnjama po sigurnost Bosne i Hercegovine, kako unutar, tako i van države. Agencija je odgovorna za analiziranje prikupljenih podataka i njihovo prenošenje ovlaštenim dužnosnicima i tijelama (najvši organi vlasti i njihovi predstavnici), kao i za prikupljanje i analiziranje i prenošenje obavještajnih podataka sa svrhom pružanja pomoći ovlaštenim službenim osobama, kako je difinirano zakonima o krivičnom postupku u Bosni i Hercegovini, te ostalim mjerodavnim tijelima u BiH, kada je to potrebno radi suzbijanja prijetnji po sigurnost Bosne i Hercegovine.

    Zakonom su jasno definirane "prijetnje po sigurnost Bosne i Hercegovine". U tom kontekstu kao takve smatrat će se prijetnje suverenitetu, teritorijalnom integritetu, ustavnom poretku, osnovama ekonomske stabilnosti BiH, kao i prijetnje po globalnu sigurnost koje su štetne po Bosnu i Hercegovinu (ali i za region, EU i svijet u cjelini).

    Radi se o prijetnjama sa aspekta terorizma, uključujući međunarodni terorizam; prijetnjama sa aspekta špijunaže usmjerene protiv Bosne i Hercegovine ili štetne po sigurnost BiH na bilo koji drugi način; prijetnjama sa aspekta sabotaža usmjerenih protiv vitalne nacionalne infrastrukture Bosne i Hercegovine ili na drugi način usmjerenih protiv BiH; prijetnjama sa aspekta organiziranog kriminala usmjerenog protiv Bosne i Hercegovine ili štetnog po sigurnost BiH na bilo koji drugi način; prijetnjama sa aspketa trgovine drogama, oružjem i ljudima usmjerene protiv Bosne i Hercegovine ili štetne po sigurnost BiH na bilo koji drugi način; prijetnjama sa aspekta nezakonite međunarodne proizvodnje oružja za masovno uništenje, ili njihovih komponenti, kao i materijala i uređaja koji su potrebni za njihovu proizvodnju; prijetnjama sa aspekta nezakonite trgovine proizvodima i tehnologijama koje su pod međunarodnom kontrolom; prijetnjama sa aspekta radnji kažnjivih po međunarodnom humanitarnom pravu i prijetnjama sa aspekta djela organiziranog nasilja ili zastrašivanja nacionalnih ili vjerskih grupa u Bosni i Hercegovini.

    PLACE AND ROLE OF INTELLIGENCE AND SECURITY AGENCY OF BOSNIA AND HERZEGOVINA IN SECURITY SYSTEM OF BOSNIA
    AND HERZEGOVINA

    Reform of security agencies in Bosnia and Herzegovina was set as one of the key requirements for beginning of negotiation of Bosnia and Herzegovina with European Union for agreement about stabilization and associating. International community has requested Law of unique intelligence and security service to be adopted as soon as possible and first initiative started in 2002 after November conference in London when the "London's declaration of organized crime on Balkan" was adopted.

    This huge International Conference about organized crime in south-eastern Europe, hosted by British Government, showed that the struggle against organized crime has been included in main activities, not only by states in region, but also by International Community, in this case represented by European Union. That determination has required reform of security system in Bosnia and Herzegovina, and in the region as whole, with aim of more efficient and more organized struggle against threats posed by international organized crime and terrorism.

    Participants of the Conference in London committed themselves to struggle against organized crime on its source, in transit, through border line crossings and, at least, at the main destination, more precisely by activities against criminals from the region who operate in foreign countries. International Community, as it was mentioned in this document, will continue to provide support to countries in the region to fulfill obligations taken by participants at the Conference in London, which will have to make, in return, tangible results.

    Exactly that -tangible results- are expected now from Intelligence and Security Agency of Bosnia and Herzegovina, which has got the important place in Bosnia and Herzegovina and in region, that through cooperation with other Institutions in security system within and out of Bosnia and Herzegovina, responds to competences, which were precisely stated by foreign and domestic law experts, and realized by legislative body when adopting Law about Intelligence and Security Agency of Bosnia and Herzegovina, in which way this institution has been placed in focus of internal, regional and European efforts in struggle against criminal and corruption and in introducing the rule of justice in the region.

    ESTABLISHING OF INTELLIGENCE AND SECURITY AGENCY OF BOSNIA AND HERZEGOVINA

    On 22 March 2004 based on Article IV.4.a of Constitution of Bosnia and Herzegovina, Parliament Assembly of Bosnia and Herzegovina, at the session of House of Representative and House of People, adopted Law of Intelligence and Security Agency of Bosnia and Herzegovina. This law came into force eighth day after been published in Official Gazette of Bosnia and Herzegovina, number 12 from 14 April 2004, and the Agency started to work on 01 June 2004.

    The Law established the Intelligence and Security Agency which is responsible for collecting, analyzing and distribution intelligence information with aim to protect security, including sovereignty, territorial integrity and constitutional order.
    It is important to emphasize that the Agency carries out its duties in according to regulation of Constitution of Bosnia and Herzegovina, including regulation of European Convention for Protection Human Rights and Main Freedoms and its Protocols, International contracts and agreements which Bosnia and Herzegovina signed or joined to.

    According to the Law's solutions, the Agency is civilian intelligence and security Institution that has status of independent administrative organization in Bosnia and Herzegovina. The Agency has a status of legal person.

    Agency combined civilian intelligence and security Institutions which were working formerly in entities - Federation of Bosnia and Herzegovina and Republic Serbska. Law forbids all other civilian intelligence and security agencies to be established or to work in Bosnia and Herzegovina.

    Funding for the Agency is provided in whole from the state budget, in according to Law which regulates Treasury of Bosnia and Herzegovina's Institutions.






    COMPETENCE OF INTELLIGENCE AND SECURITY AGENCY OF BOSNIA AND HERZEGOVINA

    Intelligence and Security Agency is responsible for collecting intelligence information related to threats against security of Bosnia and Herzegovina, not only inside, but also out of the State. The Agency is responsible for analyzing of gathered information and providing it to authorized officials and bodies (highest authorities and its representatives), and also is responsible to collect, analyze and pass intelligence information with aim to provide support to the authorized officials, as it is defined by the Criminal Code of Bosnia and Herzegovina, and to other relevant bodies in Bosnia and Herzegovina, when its necessary for repressing threats to security of Bosnia and Herzegovina.

    "Threats to the security of Bosnia and Herzegovina" are distinctly defined. In that context, threats are considered as threats to sovereignty, territorial integrity, constitutional order and basics of economical stability of Bosnia and Herzegovina, and also threats to global security which are harmful for Bosnia and Herzegovina (and also for region, EU and World in the whole).

    It is about threats from aspect of terrorism, including international terrorism; threats from aspect of espionage directed against Bosnia and Herzegovina or harmful for security of Bosnia and Herzegovina in anyway; threats from aspect of sabotage directed against vital national infrastructure of Bosnia and Herzegovina, or in other way directed against Bosnia and Herzegovina; threats from aspect of organized crime directed against Bosnia and Herzegovina or harmful for security of Bosnia and Herzegovina in anyway; threats from aspect of drugs, or weapons and human trafficking directed against Bosnia and Herzegovina, or harmful for security of Bosnia and Herzegovina in anyway; threats from aspect of illegal production of weapons for mass destruction, or its components, as well as materials and devices needful for its production; threats from aspect of illegal trafficking with products and technology which are under International control; threats from aspect of acts punishable by International Humanitarian Law and threats from aspect of organized crime or threats to national or religious groups in Bosnia and Herzegovina

    SIPA - State Investigation And Protection Agency
    Državna agencija za istrage i zaštitu (SIPA)


    Državna agencija za istrage i zaštitu (SIPA) je osnovana 2002. godine, usvajanjem Zakona o Agenciji za informacije i zaštitu, kojim je ova agencija definirana kao samostalna institucija BiH, odgovorna za prikupljanje i obradu podataka od interesa za provođenje međunarodnih i krivičnih zakona BiH, kao i za zaštitu vrlo važnih ličnosti, diplomatsko-konzularnih predstavništava i objekata institucija Bosne i Hercegovine, te diplomatskih misija.
    Usvajanjem Zakona o Državnoj agenciji za istrage i zaštitu, u junu 2004. godine, Agencija za informacije i zaštitu je transformirana u Državnu agenciju za istrage i zaštitu, te je dobila policijska ovlaštenja i postala prva policijska agencija koja svoju nadležnost ostvaruje na cijeloj teritoriji BiH. Ovim zakonom SIPA je definirana kao upravna organizacija Ministarstva sigurnosti BiH sa operativnom samostalnošću, čije su nadležnosti sprečavanje, otkrivanje i istraga krivičnih djela iz nadležnosti Suda BiH, fizička i tehnička zaštita štićenih ličnosti i objekata, zaštita ugroženih svjedoka i svjedoka pod prijetnjom i drugi poslovi iz njenog djelokruga koji su određeni ovim zakonom.
    Akcije SIPA-e na hapšenju osoba osumnjičenih za ratne zločine, uspješno provedene istrage krivičnih djela pranja novca, organiziranog kriminala, terorizma, trgovine ljudima i ostalih krivičnih djela, kao i pružanje podrške i zaštite svjedocima, uspješno obavljanje poslova i zadataka zaštite ličnosti i objekata, formiranje specijalne jedinice, samo su neke od činjenica koje govore o uspješnosti SIPA-e od osnivanja do danas.
    S obzirom da je kriminal, posebno organizirani, poprimio međunarodni karakter, Državna agencija za istrage i zaštitu sprovodi koordiniranu saradnju sa domaćim i međunarodnim organima za provođenje zakona, kako bi borbu protiv svih vrsta kriminala učinila što efikasnijom, te na taj način podigla stepen globalne sigurnosti na još veći nivo.




    The State Investigation and Protection Agency (SIPA) was established in 2002 upon the adoption of the Law on the Agency for Information and Protection, which defines the Agency as an independent institution of Bosnia and Herzegovina (B&H) in charge of collection and processing of information of interest for implementation of international laws and B&H Criminal Codes, as well as for protection of VIPs, diplomatic and consular missions and government institutions of Bosnia and Herzegovina. In June 2004, after the adoption of the Law on the State Investigation and Protection Agency, the Information and Protection Agency was transformed into the State Investigation and Protection Agency, becoming the first police agency with full police authorizations and competences across the entire B&H territory. This Law defines SIPA as an operatively independent administrative organization within the Ministry of Security of B&H whose competencies include prevention, detection, and investigation of criminal offences falling within jurisdiction of the Court of B&H, physical and technical protection of VIPs and buildings, protection of endangered and threatened witnesses as well as other duties falling within its competencies as prescribed by the Law. SIPA’s actions on apprehension of persons suspected of committing war crimes, successful investigations of criminal offences of money laundering, organized crime, terrorism, trafficking in human beings, and other criminal offences, as well as providing witness support and protection, successful performance of duties and tasks related to protection of VIPs and buildings, establishment of the Special Support Unit, are only some of the facts confirming SIPA’s achievements to date. Since crime, particularly the organized crime, has assumed an international character, the State Investigation and Protection Agency carries out coordinated efforts in cooperation with domestic and international law enforcement agencies with a view to make combating crime more efficient and increase global security.
